中非合作论坛设立以来,中非经贸关系得到迅猛发展。在中非经贸关系的发展过程中,也产生了大量法律问题,涉及投资、民商事、刑事、税收等许多领域。但目前中非之间调整上述领域的法律框架还存在一些问题,如相关双边条约数量较少,有些条约的内容比较陈旧,许多规定还存在模糊、不一致的地方等。从长远来看,中非经贸关系的发展需要双方加强双边法制合作。中非加强双边法制合作是保障中非经贸关系长远健康发展的需要,是解决中非现实法律问题的需要,也是推动国际经贸规则改革的需要。结合中非双边法制合作的现状和中非的具体情况,中非可以从以下几方面完善双边法制合作:一是加强现有的双边法制合作框架,推动与更多非洲国家商签投资保护条约、民商事和刑事司法协助条约、税收条约等,同时补充、完善条约的某些规定,使它们更符合中非经贸关系发展的需要;二是尽快同一些非洲国家和地区性经济组织商签自贸协定,为中非经贸关系的发展提供牢固的法律框架;三是拓展中非双边法制合作的领域,加强在立法、司法和执法等领域的交流与合作;四是重视多边领域的法制合作,利用多边途径加强在跨国犯罪、反腐、民商事和税收等领域的合作。

Bilateral trade between China and Africa has developed rapidly in recent years.Since 2009, China has been Africa's largest trading partner for 10 consecutive years.ln his keynote speech at the opening ceremony of 2018 Beijing Summit of Forum on China-Africa Cooperation (FOCAC), President Xi Jinping made it clear that the building of the Belt and Road Initiative should align with the development strategies of African countries and build a closer China-Africa community with a shared future. To this end, he proposed that China should work closely with African countries in the next 3 years and beyond to implement the "Eight Major Initiatives". These cover the following 8 areas: industry promotion, infrastructure connectivity, trade facilitation, green develop-ment, capacity building, health, people-to-people exchanges and peace and security. The implementation of the "Eight Major Initiatives" will bring a rare historic opportunity for the development of China-Africa economic and trade relations. With the development of investment and trade between China and Africa and the further strengthening of cultural and people-to-people exchanges between China and Africa, there are bound to be a large number of economic, trade and investment disputes,civil and commercial disputes and various criminal cases between China and Africa . It is proposed in the Initiatives adopted at previous FOCAC that China and Africa should negotiate and sign more bilateral treaties on investment and judicial assistance in the field of legislation, justice and law enforcement.But, with the rapid development of China-Africa economy, trade, investment and cultural exchanges, the current legal construction is still lagging behind and can't provide effective legal guarantee for bilateral exchanges and cooperation.
