社会法学在西风东渐中产生。欧美、日本是来源地，留学生是主要传播主体，法学院以及法律书刊是主要阵地，社会主义思潮的强势崛起是时代底色和助推力量。因受来源国别、院系格局、传播媒介、现实政治等因素影响，社会法学呈现出复杂图景。社会法学与本土文化相碰撞而产生的新变种——三民主义法学，隐去了对个人价值的尊重，并将国家、民族与社会的概念混为一谈。社会法学关于法律要采取社会本位的核心主张，逐渐偏离了原来的轨迹。

Social jurisprudence emerged in the west wind. Europe, the United States and Japan are the places of origin, international students are the main dissemination subjects, law schools and legal books and periodicals are the main positions, and the strong rise of socialist ideology is the background and driving force of the times. Due to the influence of factors such as the country of origin, the pattern of faculties, the media and realpolitik, social law presents a complex picture. The Three People's Principles jurisprudence, a new variant of social jurisprudence that collides with local cultures, conceals respect for individual values and confuses the concepts of state, nation and society. The core proposition of social jurisprudence that law should adopt a social standard has gradually deviated from the original trajectory.
