The status of international treaties in China's legal system has attracted much academic attention and has long been a problem in practice. The root cause lies in the "silence" of the Chinese constitution on the relationship between international treaties and domestic law. Through empirical research based on first-hand information, this book aims to grasp the current situation of the relationship between international treaties and China's domestic law, explore the problems therein, and provide a basis for institutional design. The book has distinctive features: first, a comprehensive examination of the actual status of international treaties in China's legal system from the perspectives of legislation, law enforcement and justice; The second is to sort out how the constitutions of 193 countries in the world stipulate the relationship between international treaties and domestic laws for reference; The third is to systematically put forward specific proposals for improving China's system from the constitutional, legislative and judicial levels.(AI翻译)
