内容简介

《中国文化法学评论》系深度聚焦文化法治，持续耕耘文化法学的学科建设发展，具有学术性、开放度和智库型的研究集刊。著述结合诸多案例、实例，对于文化创意、文化遗产、文化贸易、文化传播以及体育、语言等一系列具体法律问题，以国际的、比较的和在地的等多维度并集合多个法律部门展开研究。《中国文化法学评论》年刊汇集新近文化法治研究的优秀学术成果，针对文化遗产保护、文化产业发展、公共文化服务、文化市场监管以及文化治理发展研究等领域突出的立法、执法和司法等理论和实践问题，努力归纳提炼文化人权，文化主权，文化产权，文化法治的基本理论，为进一步夯实文化法学的理论基础，丰富和发展文化法学的学科内涵，构建和完善文化法学的理论体系，发挥文化法治研究基地的智库功能提供成果园地、交流平台和传播桥梁，具有理论探索和实践参考的鲜明特色和现实意义。

The Chinese Cultural Law Review is a research collection that deeply focuses on cultural rule of law, continues to cultivate the discipline construction and development of cultural law, and is academic, open and think-tank. His writings combine many cases and examples to conduct research on a series of specific legal issues such as cultural creativity, cultural heritage, cultural trade, cultural communication, sports, language, etc., in an international, comparative and local manner. The annual journal of China Cultural Law Review brings together the excellent academic achievements of recent cultural rule of law research, and strives to summarize and refine the basic theories of cultural human rights, cultural sovereignty, cultural property rights and cultural rule of law in view of prominent theoretical and practical issues in the fields of cultural heritage protection, cultural industry development, public cultural services, cultural market supervision and cultural governance development research, so as to further consolidate the theoretical foundation of cultural law and enrich and develop the disciplinary connotation of cultural law. Constructing and improving the theoretical system of cultural jurisprudence, giving play to the think tank function of the cultural rule of law research base, providing a place of achievement, a platform for exchange and a communication bridge, has the distinctive characteristics and practical significance of theoretical exploration and practical reference.

石东坡，教授，西北政法学院法学学士、法学硕士，北京大学法学博士，厦门大学法学博士后研究人员，浙江省高校学科带头人、浙江工业大学文化与法制研究中心主任暨文化法治创新团队首席专家，中国法学会立法学研究会常务理事，北京大学立法学研究中心研究员，中共浙江省委法治浙江专家咨询委员会专家、浙江省人民政府法律顾问、浙江省人大常委会立法咨询委员会委员。发表论文100余篇，著有《科学立法：规律与机制》等专著、教材多部，主持承担国家社科基金重大项目子课题，国家社科基金、教育部、中国法学会、省软科学、省哲学社会科学基金项目多项。主要研究方向：立法学、文化法学、行政法学。
